Odometer Fraud
An odometer is a meter on a vehicle that should, if operating properly, generally indicate the number of miles the vehicle has traveled or was driven since it was new. Parties use the "mileage" of a vehicle, as indicated by the odometer, as a significant factor in determining the value of a vehicle.
Perhaps one of the oldest forms of car fraud involves odometer tampering. Odometers in older vehicles were purely mechanical - the wheels on the odometer turned as a result of mechanical actions beginning with the turning of the vehicle's axles. It was generally easy to "roll back" the miles on an odometer. It is more difficult to turn back the miles on newer vehicles, due to the use of electronic odometers. Nevertheless, equipment is available to assist an unscrupulous person in doing so. A more common way that car dealers change the odometer on a vehicle is by replacing the instrument cluster.
The "rolling back" of an odometer with the intent to mislead a purchaser as to a vehicle's mileage is fraud. There are also statutes which specifically prohibit such conduct. A consumer can sue for, among other things, the diminished value of the vehicle as a result of the "roll-back."
