The "American Dream" includes, for many people, not just the purchase of a home, but also a new car. There are few scents like the "new car" scent. Many consumers arrive at a dealership with a budget and a vehicle in mind and leave with something far different.
It is reasonable for a consumer, when making perhaps the second largest purchase she will make, to take the time to shop around. However, some dealers will not take "no" for an answer, even if a consumer does not appear to be qualified to obtain financing for a vehicle. Some dealers will convince a consumer that she has completed the purchase of a vehicle, by completing a retail installment agreement. The consumer leaves the dealership, happy with her new "purchase." She shows the vehicle to her friends, family, and co-workers. However, several days later, the dealer calls the consumer and tells her to return the car. The dealer tells the consumer that the dealer was not able to obtain financing. The consumer is confused and upset, to say the least.
Such "spot sales" can be improper, depending on the circumstances. The documents signed by the consumer and dealer, as well as representations made by the dealer regarding the sale, should be reviewed by an attorney for an opinion.
