Wrongful Repossession

A car dealer can repossess a vehicle only if it is allowed by statute to do so.  A car dealer must also generally have a contractual right to repossess a vehicle that it has sold to a consumer.  For example, a contract between a consumer and a car dealer-creditor might allow the dealer to repossess the car if payments are not made timely.  Or, the same contract might allow repossession if a consumer fails to maintain appropriate insurance on the vehicle.

Generally, if a consumer complies with his obligations in a contract between him and a car dealer-creditor, then the car dealer will not have a right to repossess a vehicle.  However, if allowed by contract and law, if a consumer materially breaches such an agreement, then the dealer may use the "self-help" remedy of repossession.  Nevertheless, the dealer may not breach the peace when attempting to repossess the vehicle.  "Breach of the peace" is a fact issue, and any such occurrence should be reviewed by an attorney for a legal opinion.
